Terms of Service

The rules for using duckk — the consumer AI assistant and the developer API gateway — written in plain language first, legal detail second.

18 min readEffective: 1 September 2026

Summary

These Terms of Service (“Terms”) govern your access to duckk.org, the duckk chat assistant, and the developer API gateway at api.duckk.org/v1, all operated by Duckk, Inc. (“Duckk”, “we”, “us”). By creating an account, using the chat, purchasing a subscription or topping up API credit, you agree to these Terms and to our Privacy Policy. If you use duckk on behalf of a company, you represent that you have authority to bind that company.

1. Agreement & scope

In short: Using duckk — chat or API — means you accept these Terms. They cover the website, the apps and the gateway.

These Terms form a contract between you and Duckk, Inc. (contact: legal@duckk.org). They cover duckk.org, the duckk chat assistant (including agent mode, file uploads, image and presentation generation, web search and voice features), guest access, and the OpenAI-compatible API gateway at api.duckk.org/v1.

Product-specific terms for beta features are incorporated when you opt into those features. If you have a signed enterprise agreement with Duckk, it prevails over these Terms to the extent of any conflict. Previous versions of these Terms are available on request.

2. Age, accounts & security

In short: You must be at least 16. Keep your password, MFA and API keys safe — you are responsible for everything that happens under them.

You must be at least 16 years old (or the age of digital consent in your country, if higher) to use duckk. Provide accurate registration information and keep it up to date.

Authentication is provided by Clerk, supporting email and password, one-time codes, multi-factor authentication, and Google, Facebook or Microsoft sign-in. You are responsible for keeping your credentials confidential and for all activity under your account.

API keys are scoped to your account. Never embed secret keys in client-side code or public repositories; use environment variables or a secrets manager and rotate keys regularly. Notify legal@duckk.org promptly of any unauthorized use — we may rotate or revoke compromised keys to protect the service.

  • Guest access lets you try duckk without an account for a limited time; guest sessions are rate-limited and may be reset at any time.

3. The service & changes

In short: duckk routes your requests to 30+ AI models through our gateway. The model catalogue evolves, and beta features are provided as-is.

duckk provides a consumer AI assistant — multi-model chat across 30+ models, agent mode with task execution and approvals, code sandbox execution, image and presentation generation, web search with citations, file upload and parsing, voice input and read-aloud, and conversation sharing and export — plus a developer API gateway that routes to providers such as OpenAI, Anthropic, Google, Meta, Mistral, DeepSeek and Moonshot/Kimi.

We may add, change or remove models, providers, features, limits or pricing as the service evolves. The model catalogue is dynamic: a model available today may be deprecated tomorrow, and we will give reasonable advance notice where commercially practical.

Beta or experimental features are provided as-is, may be throttled, changed or withdrawn at any time, and are excluded from any uptime commitment.

Note: Guest access and free quotas are a trial convenience, not a guaranteed service level.

4. Your content & AI output

In short: You keep your inputs. We assign you our rights in the output — but AI output is not unique, and others may receive similar results.

Input: you retain all rights to the prompts, files, images and other content you submit (“Input”). You grant Duckk a limited, worldwide licence to host, process and transmit your Input solely to operate the service and keep it safe — never to train models (see our Privacy Policy).

Output: subject to these Terms and to your underlying rights, Duckk assigns to you all right, title and interest it may have in the content generated for you (“Output”), to the extent permitted by applicable law.

Similarity of Output: generative AI is probabilistic. Other users may ask similar questions and receive similar or identical Output. Output generated for another user is not your content, and the assignment above does not extend to it.

You are responsible for your Input and for how you use Output — including ensuring it does not infringe third-party rights. Some jurisdictions do not recognize copyright in AI-generated material; the assignment above does not change that.

5. AI accuracy & no professional advice

In short: AI can be confidently wrong. Verify important output, and never rely on duckk for medical, legal or financial decisions.

Output from large language models is probabilistic and may be inaccurate, incomplete, biased, outdated or entirely fabricated (“hallucinated”) — even when it reads as confident and cites sources. Web search citations may misattribute or misread the underlying page.

duckk does not provide medical, legal, financial, tax or other professional advice. Output is general information only. Do not use duckk for decisions affecting health, safety, rights, employment, credit or finances without review by a qualified human.

You are solely responsible for evaluating Output before relying on it or sharing it, and for disclosing AI involvement where the law requires it.

6. Acceptable use & enforcement

In short: No illegal use, no bypassing safety limits, no training competing models on duckk output, no passing AI output off as human work.

You agree to use duckk in compliance with applicable law — including data-protection laws such as the GDPR, POPIA, NDPA and the Kenya Data Protection Act, and applicable export controls and sanctions — and not to do any of the following:

  • Break the law or violate others' rights — including generating illegal, hateful, harassing, sexually exploitative or non-consensual content, or content that infringes intellectual-property rights.
  • Attempt to bypass the safety filters, guardrails, rate limits, quotas or access controls of duckk or any upstream provider.
  • Use Output to develop, train or improve models that compete with duckk or its upstream providers.
  • Misrepresent AI-generated Output as solely human-generated where that would deceive — for example impersonation, fraud, academic dishonesty or fake reviews.
  • Scrape the service, create accounts automatically, stuff credentials, probe vulnerabilities without authorization, or otherwise disrupt the service.
  • Resell, sublicense or white-label the API or assistant access without our prior written consent.
  • Upload content you have no right to share, or personal data of others without a lawful basis.

Note: We may review content and usage — with automated systems and, where justified, human review — to enforce these Terms, respond to abuse reports and comply with the law. Violations may lead to content removal, throttling, suspension or termination under section 13, and we may report illegal content to the authorities. If you build on the API, you must pass these restrictions on to your end-users.

7. Subscriptions, billing & refunds

In short: Pro renews automatically until you cancel (effective at the end of the period). Unused API top-ups are refundable for 30 days; consumed tokens and bonus credit are not.

Fees are exclusive of taxes unless stated. If a payment fails we may retry and suspend paid features after repeated failure. Chargebacks filed in bad faith may lead to account suspension.

8. Feedback

In short: Thumbs up/down and comments you send are stored together with the related conversation so we can improve duckk.

When you rate a response (thumbs up/down) or submit feedback, we store your rating and comment together with the content of the associated conversation so our team can review it and improve quality and safety.

Any suggestions or ideas you send us may be used without restriction or compensation. Feedback does not change the content-ownership rules in section 4.

9. Intellectual property

In short: The site, software and duckk brand belong to Duckk, Inc.; model names and provider trademarks belong to their owners.

The duckk.org site, the assistant and gateway software, the duckk name and logo, and our documentation are owned by Duckk, Inc. and licensed to you for your personal or internal business use under these Terms. You may not copy, modify, reverse-engineer or create derivative works of the service except as permitted by law.

Model names and provider trademarks belong to their respective owners; their availability on duckk does not imply endorsement. Open-source components remain under their original licences.

10. Disclaimers

In short: The service is provided as-is, without warranties of accuracy, availability or fitness for a purpose.

The service is provided “as is” and “as available”, with all faults. To the maximum extent permitted by law we disclaim all warranties, express or implied — including merchantability, fitness for a particular purpose, accuracy and non-infringement.

We do not warrant that the service will be uninterrupted, secure or error-free, that Output will be accurate, or that any model or provider will remain available. Upstream provider outages, model deprecations and content filters are outside our control.

Beta features, guest access and free quotas are provided without any service-level commitment.

11. Limitation of liability

In short: Our total liability is capped at what you paid us in the last 12 months, or USD 100 if that is higher. No indirect damages.

To the maximum extent permitted by law, Duckk's aggregate liability for all claims arising out of or relating to the service in any 12-month period is limited to the greater of (a) the amounts you paid to Duckk in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost goodwill, even if advised of the possibility. We are not liable for the acts, omissions, outages or Output of upstream model providers.

Nothing in these Terms excludes liability that cannot be excluded by law (for example for wilful misconduct), and mandatory consumer rights in your country remain unaffected.

12. Indemnification

In short: You cover claims arising from your content, your breach of these Terms, or products you build on the API.

You will indemnify and hold harmless Duckk, its affiliates, officers and employees from and against claims, damages, losses and costs (including reasonable attorneys' fees) arising from (a) your Input or your use of Output; (b) your breach of these Terms or applicable law; or (c) products or services you build on the API, including claims by your end-users.

We will promptly notify you of any indemnified claim and may participate in its defence with counsel of our choice. You may not settle any claim in a way that imposes obligations on Duckk without our prior written consent.

13. Suspension & termination

In short: Cancel anytime. We can suspend for breach, non-payment or abuse — and long-idle free accounts may be closed after notice.

You may stop using duckk at any time and delete your account in settings. Deleting your account deletes your account data — conversations, files and profile — as described in our Privacy Policy; billing records are kept as required by law.

We may suspend or terminate access if you materially breach these Terms, fail to pay, create risk or abuse the service, or if we are required to do so by law or by an upstream provider. For curable breaches we will give notice and a reasonable chance to cure where practical; for security, abuse or legal compliance we may act immediately and notify you afterwards.

Free accounts with no activity for 12 consecutive months may be closed after at least 30 days' email notice; unused free quotas expire with the account.

On termination your right to use the service ends. Paid subscription access continues until the end of the current billing period, and API credit refunds follow section 7.

14. Changes to these Terms

In short: We announce material changes at least 14 days in advance by email or in-product banner.

We may update these Terms by posting a new version at duckk.org/terms with a new effective date. For material changes we will notify you by email or a prominent in-product banner at least 14 days before the change takes effect.

Continued use after the effective date constitutes acceptance. If you do not agree, stop using duckk and cancel your subscription before the change takes effect.

15. Governing law & disputes

In short: Mauritian law applies. Contact us first — we aim to resolve disputes informally within 45 days.

These Terms are governed by the laws of the Republic of Mauritius, without regard to conflict-of-laws rules. The courts of Mauritius have jurisdiction, subject to mandatory consumer protections that give you the right to bring a claim in your home courts.

Informal resolution first: email legal@duckk.org and we will try to resolve the dispute within 45 days before either of us starts formal proceedings.

Mandatory consumer rights under the laws of your country of residence — including in your African market — are preserved; nothing in these Terms limits them.
